Construction Defect
Roy represented the Diocese of a large national church which brought suit against a construction company and architect of an $11 million project involving the construction of a summer camp and year-round conference center in New Hampshire seeking $2 million in design and construction defects. We retained and managed five experts in the fields of architecture, construction, mold, and engineering to support the claims. The case was settled for a confidential amount after mediation and before trial.

Breach of Employment Contract
We defended a business sued by a former employer for allegedly violating an employment agreement. The Massachusetts court dismissed the lawsuit upon our filing a motion to dismiss based upon the forum selection clause in the contract.

Fraud
We brought suit on behalf of company defrauded by an independent contractor. The claims included unfair trade practices act, fraud, misrepresentation, and civil conspiracy. We won a judgment for our client.

Employment
We defended a business on claims that our clients misclassified drivers as independent contractors and not as employees, subjecting the client to possible fines and penalties for unpaid taxes. We obtained a favorable resolution with the New Hampshire Department of Employment Security.

We defended businesses on disability discrimination claim presented to New Hampshire Commission on Human Rights. Resolution reached.

We defended a business on lawsuit brought in superior court alleging disability and age discrimination. Resolution reached.

Breach of Contract
We represented a business accused of breaching a research and development contract.  After two weeks of arbitration, the arbitrator awarded our client all if its damages and denied the opposing side’s counterclaims.
